Last stage – Proposed Modifications consultation (1st March 2013 – 19th April 2013)

Warwickshire County Council invited views on the proposed changes to the Waste Core Strategy. The proposed changes took account of the representations received and issues raised during the Examination. In particular, the Council invited comments on whether the proposed changes made the plan:

  • legally compliant (i.e. met the requirements set out in the Planning and Compulsory Purchase Act 2004 (as amended) and the associated regulations); and
  • met the tests of soundness as set out in the National Planning Policy Framework (i.e. that they make the plan positively prepared, justified, effective and consistent with national policy).

The Inspector could only accept comments on the proposed changes to the ‘Publication’ version of the plan, rather than the Publication version itself.

A Sustainability Appraisal was also undertaken on the proposed modifications and the Council also invited any comments on the Sustainability Appraisal as well as the proposed modifications.

The consultation ran from 1st March 2013 until 4:30pm on Friday 19th April 2013.

Previous stage – Submission

Warwickshire County Council formally submitted its waste plan to the Secretary of State on 19th October 2012.

The Secretary of State appointed Elizabeth Ord LLB (Hons), LLM, MA, DipTUS as the Planning Inspector to undertake the independent examination into the soundness of the Warwickshire Waste Core Strategy. The role of the Planning Inspector was to assess whether the plan:

i) was legally compliant (i.e. meets the requirements set out in the Planning and Compulsory Purchase Act 2004 and associated Regulations); and

ii) met the tests of soundness set out in the National Planning Policy Framework (i.e. that the plan is positively prepared, justified, effective and consistent with national policy).

The full range of submitted documents is available on the Council’s Waste Core Strategy document library webpage. Hard copies of all submitted documentation was available for viewing during normal opening hours at the Warwickshire County Council Offices, Planning and Development Group, Shire Hall, Warwick, CV34 4SA and each of the District and Borough Council Planning receptions. Hard copies of the final plan and CDs containing all submitted documentation were also available for inspection at all Warwickshire libraries.

An Independent Programme Officer was appointed, Mrs Bee Choo Yew-Booth, to facilitate the examination process. The Programme Officer acted as the point of contact for any person who made representations at the Publication stage, and as a liaison between the Inspector, the Council and Representors. The Programme Officer acted independently on behalf of the Inspector to organise and manage the administrative and procedural matters of the examination process and was the first point of contact for any questions relating to timetabling or procedural matters.

Publication (‘Regulation 20’) consultation stage

On 30th March 2012, Warwickshire County Council held a consultation on its Waste Core Strategy Publication Document (PDF, 28.51 MB). The purpose of the consultation was to invite representations on whether the plan had met all legal and procedural requirements and was ‘sound’. The Representation Form (DOC, 96.5 KB) and Guidance Notes (PDF, 140.86 KB) on the representation procedure helped to frame comments and to explain what was meant by ‘sound’.

The consultation was originally due to last for 8 weeks. However, the Council decided to extend the consultation period so that stakeholders had an opportunity to consider the newly published NPPF and to decide whether the Waste Core Strategy was consistent with national policy and met all of the soundness tests. As a result, the deadline for comments was extended to 4.00pm on Friday 15th June 2012.

Representations could be submitted by downloading and complete the Representation Form (DOC, 96.5 KB) and emailing to planningstrategy@warwickshire.gov.uk or by sending completed hard copies to Waste Core Strategy Publication consultation, Planning and Development Group, Sustainable Communities, PO Box 43, Shire Hall, Warwick CV34 4SX.

Supporting documentation and evidence base work

Hard copies of the ‘Publication’ document and CDs containing the supporting technical information were available at all Warwickshire libraries.

Furthermore, hard copies of the ‘Publication’ document and supporting technical information were also available for inspection during normal opening hours at the Warwickshire County Council Offices, Shire Hall, Warwick, and each of the District and Borough Planning receptions.

Officers considered all of the responses and produced a Statement of Representations summarising the main issues raised in the representations. Any necessary amendments were included in a ‘Schedule of Changes’. The representations and the Schedule of Changes were reported to the County’s Full Council meeting on the 25th September 2012. County Council members considered the documents and approved the Submission of the Waste Core Strategy to the Secretary of State for independent examination.

Previous consultation stage – Preferred Option and Policies consultation

We consulted on the Preferred Option and Policies consultation document as part of the Waste Development Framework Core Strategy from 26th September 2011 to 22nd November 2011. The feedback received during the previous ‘Emerging Spatial Options’ consultation was used to produce the consultation document. The consultation sought views from a wide range of stakeholders on:

  • the Core Strategy’s vision and objectives;
  • the preferred option for locating waste developments in the County;
  • the overarching Core Strategy policies for providing new waste infrastructure in the County; and
  • the Development Management policies that will be used to assess planning applications.

Previous Stages of Consultation

Numerous stages of consultation had been undertaken prior to the Preferred Option and Policies consultation stage. The comments received were taken into account and used to produce the current consultation document. The consultation stages are set out in chronological order below.

Preliminary consultation

A preliminary consultation took place in August 2005. The responses to the Preliminary Consultation were considered in the production of the Issues and Options proposals.

Issues and Options consultation

The second stage of consultation outlined the waste planning issues in Warwickshire and the options for dealing with them. This stage of consultation closed on 10th April 2006. The comments received were considered and used to inform the Preferred Options stage.

Preferred Options consultation

The Preferred Options and Proposals Paper consultation ended on 11th October 2006.

Revised Spatial Options consultation

The next stage of the Waste Core Strategy ought to have been submission. However following advice received from Government Office West Midlands (GO-WM) and Communities and Local Government over the summer 2008 it was necessary to review our our approach. It was agreed with GO-WM that the Core strategy needed to be taken back to the options stage. Although consultation had already been undertaken, the spatial options to deliver the waste strategy had not been considered in sufficient detail to meet the test of soundness.

Consultation on the Waste Core Strategy – Revised Spatial Options was planned for June 2008. A consultation document was produced and this was presented to Cabinet on 22nd May 2008 for approval.

However, in parallel to work on the Waste Core Strategy, the County Council was working with sub-regional partners, Coventry City Council and Solihull Metropolitan Borough Council, in bringing forward a shared residual waste treatment facility known as “Project Transform”. This delayed progress as the spatial implications of the project had to be understood before the plan’s options could be considered.

As a result, the Council recommenced work on the Waste Core Strategy in the autumn of 2010 and an Emerging Spatial Options document was produced for consultation in March 2011.

Emerging Spatial Options consultation

We consulted on the Waste Core Strategy – Emerging Spatial Options between 21st March 2011 to 6th May 2011. The consultation sought comments on:

  • 5 ‘spatial options’ for locating new waste development in the County over the next 15 years
  • key waste planning issues that have been refined through previous stages of consultation
  • 13 broad policy directions and Policy Principles to address the key issues for waste planning
  • the Vision and Key Objectives for the Waste Core Strategy.

Waste Site Specific Allocations

At the present time, it is not envisaged that site allocations for waste facilities are required. However, the Council will continue to monitor policy implementation and permitted capacity on an annual basis. If this monitoring indicates that there is clearly a significant shortfall in capacity to the extent where mandatory landfill diversion targets are unlikely to be achieved, then a Site Allocations DPD may be produced to address such a capacity shortfall.
