The NERC Act


What is the NERC Act?

The NERC Act (2006) is the Natural Environment and Rural Communities Act (2006). This legislation means that, from 1 October 2006, all local authorities and other public authorities in England and Wales have a duty to promote and enhance biodiversity in all of their functions.

The act aims to raise the profile of biodiversity and to make sure that it is considered in all local authority decisions and policies.

The official wording of the legislation, in section 40 of the Act, states that:

"Every public authority must, in exercising its functions, have regard, so far as is consistent with the proper exercise of those functions, to the purpose of conserving biodiversity."
