Property Searches - Public Rights of Way

When buying land or property, it is normal to carry out a search of the highway records in the vicinity of the land or property.

The ‘List of Streets’ is the list of publicly maintainable highways and in Warwickshire, this comes in two parts
Part 1 – Streets
Part 2 – The Definitive Map and Statement of Public Rights of Way
(N.B. There is some overlap of these records, so it is advisable to check both.)


Searches of these records are normally carried out as part of the CON29 form which is submitted by a solicitor on behalf of a client. The rights of way question on this form is optional, but we recommend that it is carried out in most cases, as the situation on the ground does not always reflect the legal record.

What is freely available?

The List of Streets (including Part 1:Streets and Part 2:The Definitive Map and Statement) are freely available to the public, and can be viewed in Warwick Library in Barrack Street, Warwick.

The published Definitive Map and Statement is a legal document in its own right, showing rights of way as at 1 October 1997. The map is published at a scale of 1:10000. A separate list “Legal Changes since 1 October 1997” is maintained which records legal changes to that Definitive Map since it was published.

What further information is available?

Extracts of the Definitive Map
Extracts of the working copy of the Definitive Map are available for
£4 for an A4 or A3 extract
If a larger extract is needed, the cost is based on the staff time needed to prepare it (minimum £10). Please contact the Countryside Access team for a quote.
    Large Scale location Plan
    If a large scale plan is required, it is necessary to request a search.

    Property Searches
    A detailed highway search enquiry includes (if requested) information about any claims for additional rights of way, or claims to upgrade (or downgrade) rights of way over a land parcel. The rights of way team will also provide a large scale plan or mark Definitive rights of way on a large scale plan provided by a solicitor or search company, as part of the enquiry.
    This costs £30 per property/land parcel.
